Payment Policy

All payments must be paid in person thru Zelle, Cashapp or cash in advance of your rental. If you currently have a reservation and would like to add another person for the same day, we will do our best to accommodate your request, taking into consideration the number of participants already booked for the tour. Please note that we can accommodate a maximum of six bikes at a time.

Weather Policy

Our tours are typically unaffected by weather conditions, except in the event of lightning, extreme winds, or heavy rain. If such conditions are present on the day of your scheduled tour, we will be happy to offer you the option to reschedule for a later date or provide a full refund of your payment. Your safety and comfort are our top priorities.

Refund Policy

Refunds will be granted in the event of lightning, extreme wind, or heavy rain. In the unfortunate event of an accident or health issue, we will certainly consider your circumstances; Your safety and well-being are important to us, and we aim to provide reasonable accommodations in such cases.

Waiver and Release of Liability Agreement

Business: Solstorm Consulting LLC dba “SPB Water Bikes.” Activity: Rental and operation of water bikes, related instruction, transport, and use of premises and equipment.

1. Acknowledgement of Risk and Assumption of Risk

I, the undersigned, acknowledge that use of water bikes involves inherent risks including drowning, collision, capsizing, equipment failure, weather, currents, and other hazards that can cause serious injury or death. I voluntarily assume all risks, known and unknown, associated with participation and rental. I understand and accept these risks.

2. Release and Waiver of Claims

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue SPB Water Bikes, its owners, officers, employees, agents, contractors, and affiliates (collectively “Released Parties”) from any and all liability, claims, demands, causes of action, or suits for damages arising out of my participation or rental, including claims based on the ordinary negligence of the Released Parties.

3. Exceptions for Gross Negligence and Intentional Misconduct

This release does not apply to claims arising from the Released Parties’ gross negligence, willful misconduct, or criminal acts, which cannot be waived as a matter of public policy under Florida law.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost (including attorneys’ fees) arising from my negligent or intentional acts, or from claims by third parties related to my participation.

5. Rules, Safety, and Equipment

I agree to follow all safety instructions, wear provided safety equipment (including life jackets) at all times, and to immediately report equipment problems or unsafe conditions. I certify I am physically able to participate and can swim or will remain within designated safe areas.

6. Medical Authorization

In the event of injury or illness, I authorize the Released Parties to obtain emergency medical care for me and agree to be responsible for all medical costs.

7. Minors

If participant is under 18, a parent or legal guardian must sign below. The guardian represents they have legal authority to sign and agrees to all terms on behalf of the minor. Florida courts scrutinize waivers signed for minors; obtain separate, conspicuous parental consent and consider additional safety measures.

8. Photo Release

I grant permission for photos or video taken during participation to be used for promotional purposes.

9. Severability and Governing Law

If any provision is held invalid, the remainder remains effective. This Agreement is governed by the laws of the State of Florida.

10. Acknowledgement and Signature

I have read this Agreement, understand it, and sign it voluntarily. I understand this is a legal document that affects my legal rights.

By checking the waiver acceptance box at booking, each rider confirms they have read, understood, and agreed to this Waiver and Release of Liability Agreement.
